  1. Terms and Conditions
    • Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using matangi.co.nz (the “Site”) operated by Matangi Prime Meat Limited (“Matangi”, “us”, “we”, or “our”).
    • This Agreement sets forth the legally binding terms and conditions for your use of the Site at matangi.co.nz.
    • By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you (the “customer” or “you”) agree to be bound by these Terms and Conditions.
    • Any new features or products which are added to the current store shall also be subject to these Terms and Conditions.
    • Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

  2. Refunds, Returns and Cancellations
    • If for any reason you are not happy with your order, please contact us within 24 hours of the delivery being made.
    • If your order has not been delivered within 24 hours of the expected delivery date, please notify us immediately.
    • We will not be able to refund any items which have been consumed or disposed of and we will not be liable for any product damaged as a result of it being incorrectly stored or handled after delivery.
    • We regret that we are unable to issue a credit when more than 24 hours have passed since delivery. It may take seven working days to process a credit to your nominated account.
    • If we require you to ship back products, please pack the product(s) securely in the packaging your meat was delivered to this address: Matangi, 308 Heretaunga Street East, Hastings, 4122.
    • These products must be returned in good condition, in the original packaging (if possible) to receive full credit. We will at our discretion where possible replace any damaged products or provide a refund. We may request that you provide evidence of damaged products before any refund or return is considered.
    • We are unable to accept cancellations or make changes to your order on the day of delivery, due to meat being a perishable product.

  3. Purchases
    • We will do our best to deliver on the expected delivery date, but as we use an independent company to ship our goods delivery times can vary. If you have any issues with your order, please contact us.
    • If for some unforeseen reason, we cannot supply a product that you have ordered, Matangi will contact you as soon as possible to discuss a replacement, credit or defer delivery.

  4. Orders
    • On placing an order you agree with the price in New Zealand Dollars per kilogram displayed on the website and with the estimated and approximate weight per cut chosen. The total final price will depend on the exact weight at the time of shipment. Pre-orders are placed prior to the processing of products, so the weight and total price of the order can only be estimated.
    • The total price shown on the cart is an estimate for the amount you will pay for your order.
    • We will phone you on the day of dispatch if your order is more than 10% higher than the estimate provided at the cart.  
    • On placing your order, you will be asked to enter your credit/debit card. A Stripe Payment Intent will be placed on your card, allowing us to process the payment on the day your order is dispatched.
    • Once the product is processed, and the exact weight is known, Matangi will charge your account with the exact amount (plus shipping costs) before dispatching your order.

  5. Payments
    • Payments are processed through the secure online payment gateway, Stripe. No credit card information is stored by Matangi.
    • Customers must pay for the product purchased either by internet banking or by credit card before an order will be dispatched.
    • Customers with a Matangi Trade account who receive an invoice are required to pay on the stated due date. Matangi will charge interest of 3% per month and debt collection charges on any accounts not paid by the due date.
    • You understand that your content (not including credit card information), may be transferred unencrypted and involve: (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.
    • Credit card information is always encrypted during transfer over networks.
    • The customer is liable for all costs associated with debt collection.

  6. Pricing
    • Matangi reserves the right to change prices or discontinue products (or any part or content thereof) without notice.
    • You agree to pay us for the product ordered at the price displayed on the website at the time of ordering.
    • Shipping costs are determined by location and we reserve the right to change as needed.
    • All prices on the website are GST inclusive and are displayed and processed in New Zealand Dollars.
    • All prices quoted for Trade Account Holders are GST exclusive.

  7. Delivery
    • Matangi reserves the right to withhold delivery of any product for any reason whatsoever.
    • Deliveries will be made to the address and location the customer has identified on the order and once left at the specified address the meat will be deemed to be delivered.
    • The customer will ensure Matangi or its agent is able to deliver were instructed by the Customer.
    • Matangi endeavours to dispatch all orders on the day preceding the “expected delivery date“.
    • If a customer has not received an order within 48 hours of the chosen “expected delivery date“ they are required to contact Matangi.
    • In the event the customer receives an incorrect order the customer is required to notify Matangi within 24 hours of receipt and failure to do so will deem acceptance of the meat delivered by Matangi.
    • If the customer contacts Matangi within 24 hours, Matangi will arrange for a replacement with the correct meat, if it is available.
    • If you are not completely satisfied with the quality of Matangi meat after delivery, Matangi may provide a replacement, store credit or a refund.

  8. Privacy Policy
    • Any personal information you provide to us will be collected, held and used in accordance with our Privacy Policy. This Privacy Policy also forms part of these Terms and Conditions.

  9. General Terms
    • We reserve the right to refuse service to anyone for any reason at any time.
    • The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

  10. Billing and Account Information
    • We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
    • In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
    • We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
    • You agree to provide current, complete and accurate purchase and account information for all purchases made using our Site.
    • You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
    • In case an individual order for a future delivery date exceeds the amount of NZD 500, we reserve the right to contact the customer and ask for a down payment of 20% to guarantee the order.

  11. Prohibited Uses
    • You are prohibited from using the site or its content:
      1. for any unlawful purpose;
      2. to solicit others to perform or participate in any unlawful acts;
      3. to violate any regulations, rules, orders or laws;
      4. to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
      5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
      6. to submit false or misleading information;
      7. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Site or online ecommerce platform or of any related website, other websites, or the Internet;
      8. to collect or track the personal information of others;
      9. to spam, phish, pharm, pretext, spider, crawl, or scrape;
      10. for any obscene or immoral purpose; or
      11. to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

  12. Disclaimer of Warranties and Limitation of Liability
    • We are not liable for any loss, damage or injury arising in law or tort or otherwise, for any loss, damage or injury arising directly or indirectly from any use of our Site and products supplied to you.
    • You agree to indemnify us against all liabilities, losses, claims and expenses arising directly or indirectly out of the customer’s use of the Site or delivery or failure to deliver any product.

  13. Consumer Guarantees
    • We will comply with our obligations under the Consumer Guarantees Act 1993. Nothing in these Terms and Conditions is intended to have the effect of contracting out of the Consumer Guarantees Act 1993.

  14. Severability
    • In the event that any provision of these Terms and Conditions are determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

  15. Termination
    • We may refuse any application to use our Site and we are also able to reject any orders that you place. We may also, at our discretion, suspend or terminate your access to our Site at any time for any reason.
  16. Governing law
    • These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. Any legal action against us must be taken in a New Zealand court of law.
  17. Redeeming Your Voucher
    1. Shopify vouchers can be redeemed directly through the website.
    2. Vouchers issued before 01/08/22 must be redeemed directly with Matangi. Contact nicky@matangi.co.nz to use your voucher with us.
  18. Gift Vouchers Issued Prior to 01/08/2022
    1. General Gift Voucher Terms & Conditions
      1. Vouchers are for one use only and subject to meat availability in our release season.
      2. Vouchers are not exchangeable for cash and are non-refundable and cannot be returned.
      3. The voucher's expiry date is shown on the front of the voucher. The voucher is valid up to and including the expiry date. Vouchers are in general valid for the actual and the following release season.
      4. To use the voucher, the voucher holder should provide a Scan of the voucher including the voucher's unique number.
      5. Matangi is not responsible for vouchers lost, stolen, destroyed or used without the purchaser's permission. The risk of loss passes to the voucher purchaser upon the electronic transmission of the voucher to the designated recipient.
    2. Delivery of Vouchers
      1. Vouchers issued prior to 1/8/22 are issued by email to the address specified at the time of purchase and can be sent to either the purchaser or to the gift recipient, subject to the purchaser's preference. It is the responsibility of the purchaser to correctly address vouchers. Matangi is not liable or responsible for any loss suffered as a result of a voucher via email being blocked by filters or firewalls, or where the incorrect email address has been entered by the purchaser.
